The Code of Administrative Offenses of Georgia has established punitive measures and toughened the punishment for those who misuse the emergency number 112 for falsely reporting terrorism.
The responsibility of the parent or his / her surrogate is raised in case of the following violations:
1. False notification of terrorism on “112” by a minor under 14 years of age will result in a fine of 1500 GEL for the parent or his / her surrogate.
Repeated violation of the law within 1 year will result in a fine of 2500 GEL.
2. Improper and false call to “112” by an adolescent under 16 will result in a fine of 100 to 300 GEL for the parent or his / her surrogate.
Repeated violation of the law will be fined in the amount of 500 GEL.
The direct responsibility of the initiator of the call will be raised in case of the following violations:
1. False reporting of terrorism by a juvenile over 14 years of age on “112” is punishable by 1 to 2 years of imprisonment or 2 to 5 years of imprisonment.
Repeated offense, depending on the circumstances, is punishable by imprisonment for a term of 5 to 7 years.
2. A person over 16 years of age will be fined in the amount of 300 GEL for systematically making an unintended call to “112”.
A person who commits the mentioned violation again within 1 year will be fined in the amount of 400 GEL.
Also, a person over 16 years of age will be fined 500 GEL for making a false call.
A person who commits the mentioned violation again within 1 year will be fined 1000 GEL or will be punished with administrative detention for up to 15 days.
It should be noted that in case of providing a false notification, the citizen will not be held liable if the reason for notifying “112” is his incorrect, subjective assessment of the circumstances, when due to objective circumstances, the person may assume the need for emergency assistance.
